NBU prepares response to Smiliansky’s lawsuit
Ihor Smiliansky is seeking to overturn a dismissal decision citing professional unfitness. The National Bank of Ukraine says it will present evidence and contest the claim.
The National Bank of Ukraine says it will defend its position in a court dispute with Ukrposhta chief executive Ihor Smiliansky. According to Finance.ua, Smiliansky has filed a lawsuit seeking to overturn a decision to dismiss him on grounds of professional unfitness. The regulator says it will provide evidence, explain its position and submit objections to the claim.
As of September 21, the central development is the NBU’s response to that legal challenge. The bank has publicly indicated that it intends to defend the disputed decision through the courts. Its announcement represents one party’s position; assessing the arguments and evidence is a matter for the court.
Context
The dispute concerns a decision that Smiliansky wants cancelled. Professional unfitness is the stated ground for dismissal in the reported decision, not an independent finding by this publication. That distinction matters when covering a contested personnel decision: reporting the grounds being challenged is different from endorsing them as established fact.
The parties’ positions are currently expressed through their intended legal actions. Smiliansky is seeking cancellation of the decision, while the NBU plans to explain why it considers its position justified. The regulator’s pledge to submit evidence places the emphasis on material that can be examined in legal proceedings, rather than on public assertions alone.
Objections to a claim are a means of responding to the claimant’s demands. They should not automatically be read as a separate lawsuit by the NBU against Smiliansky. Defending against a claim and bringing an independent claim are different procedural steps. The relevant point in the regulator’s response is its stated intention to contest the requested cancellation.
For a financial audience, the institutional issue is the accountability of a regulator and the justification for its decisions. Judicial challenges provide a route for decisions by public institutions to be examined under legal procedures. Filing a lawsuit does not itself establish which party’s arguments are correct; that requires consideration of the dispute.
The case also highlights the distinction between having authority to make a decision and explaining the grounds for exercising it. Institutional credibility depends on understandable procedures as well as formal powers. Here, the NBU says it is ready to present its reasoning, while Smiliansky is using a court challenge to seek a different outcome.
When following the case, the useful distinction is between statements by the parties and decisions by the court. Announcements describe intentions, submissions set out legal arguments, and judicial rulings determine the outcome of the demands considered.

The immediate position is therefore straightforward: Smiliansky is challenging the decision, and the NBU intends to defend it. The substantive outcome will depend on the legal arguments and their assessment in court.
